The court dismisses Freeman Mbowe’s case

The High Court of Tanzania Dar es Salaam Region has dismissed the constitutional case of CHADEMA Chairman Freeman Mbowe who complained that his constitutional rights were violated during his arrest, detention and eventual prosecution on terrorism charges.

The court reached the decision before Judge John Mgeta after agreeing with one of the three previous objections by the government that the application was unlawful because it violated section 4 (5) and section 8 (2) of the Justice Act. basic and implementation of chapter three responsibilities.

Judge Mgeta said Mbowe should submit his complaint to the High Court Economic Offenses Unit where it is the right place as that is where his primary case is being heard.

Mbowe filed the constitutional case on July 30 this year, in court against the Director of Public Prosecutions (DPP), the Chief of Police (IGP) and the Attorney General (AG).

In case number 21 of 2021, Mbowe opposes the procedure used to arrest him, detain him and eventually open a case of economic sabotage against him on terrorism charges.
